These Terms of Service are a legally binding agreement between you and Blue Gate International, owner and operator of Aizin. Aizin is owned and operated by Blue Gate International. By creating an account or using the service, you agree to these terms.

1. Service Definition and Provider

Aizin provides technical tools for workflows, automated responses, follow-up steps, and contact-related processes across connected services and external systems. Service ownership, operation, and administrative control are managed by Blue Gate International.

2. Account, Password, and Security

You are responsible for account credentials, access controls, and all actions taken under your account. You must promptly notify us of suspected unauthorized access.

3. Agencies and Business Owners

If an agency operates an account for a business owner, both parties are responsible for authority, permissions, and lawful handling of connected assets and content.

4. Content Responsibility and Policies

You are solely responsible for all content, data, and workflow configuration uploaded, stored, or processed through the platform. We may limit or remove material that violates laws, platform policies, or these terms.

5. User Outreach, Consent, and Compliance

If you use connected-service outreach, notification, or contact features, you are responsible for lawful permissions, valid consent, and compliance with applicable communication rules.

6. Account Data and Preferences

You confirm the accuracy of account information you provide and acknowledge that operational notices may be sent electronically. Available account preferences may be adjusted where supported.

7. Prohibited Uses

Prohibited uses include unlawful conduct, fraud, harassment, malicious automation, impersonation, unauthorized data scraping, and attempts to compromise platform integrity.

8. Commitments, Warranties, and Legal Compliance

You represent that your use of the service complies with applicable law, contractual obligations, intellectual property rights, and third-party platform requirements.

9. Platform Updates and Upgrades

We may update, improve, or modify features to maintain security, performance, and compatibility. Some functions may change, be replaced, or be discontinued over time.

10. Billing, Payment, and Refund Policy

Paid plans are billed per selected cycle. Unless explicitly stated otherwise, charges are non-refundable, and service limits are tied to your active subscription plan.

11. Account Termination and Data Retention

You may terminate your account according to available controls. We may suspend or terminate for violations, abuse, non-payment, or legal obligations, with retention handled by policy and law.

12. Integrations and External Links

Integrations with external platforms, systems, tools, or services are governed by the terms and policies of those providers. We are not responsible for third-party availability, technical outages, or external service decisions.

13. Copyright and Intellectual Property Complaints

If you believe your rights are infringed, you may submit a documented complaint. We reserve the right to review claims and take appropriate content or account actions.

14. Changes to Terms and Services

We may revise these terms when required by legal, technical, or operational needs. Continued use after updates constitutes acceptance of revised terms.

15. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis, without guarantees of uninterrupted availability, error-free performance, or suitability for every business purpose.

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages resulting from use of the service.

17. Indemnification

You agree to indemnify and hold harmless Aizin and Blue Gate International from claims, losses, or liabilities arising from your content, conduct, or legal violations.

18. Governing Law and Dispute Resolution

These terms are governed by applicable law defined by the service provider. Disputes should first be addressed in good faith before escalation to formal legal processes.

19. General and Final Provisions

These terms, together with referenced policies, constitute the complete agreement between you and the platform regarding service use.

20. Consent to Electronic Transactions

You consent to receiving legal, operational, and billing notices electronically, including by email or in-dashboard notifications.

21. Privacy and Data Security (Technical Commitment)

We process data according to documented technical safeguards and contractual obligations. We do not sell personal data, and any disclosure or transfer of data is limited to what is reasonably necessary to operate the service, support connected features or integrations, comply with legal obligations, or act on your instructions. You remain responsible for lawful data collection and user permissions.

22. Force Majeure

We are not liable for delays or failures caused by events outside reasonable control, including major outages, disasters, government actions, or security incidents.

23. Assignment and Transfer

You may not transfer your rights or obligations under these terms without prior written approval. We may assign service rights in connection with merger, acquisition, or restructuring.

24. Severability and Enforceability

If any provision is deemed unenforceable, the remaining provisions remain in full effect and enforceable to the maximum extent permitted by law.

25. Language and Interpretation

In case of interpretation conflict between translated versions, the controlling language and governing interpretation will follow the legally designated version.

26. Nature of Relationship Between Parties

Nothing in these terms creates a partnership, joint venture, employment, or agency relationship between you and the platform provider.
